Contagious Pathogens Assumption of Risk, Release of Liability + Gym Waiver
According to the Center for Disease Control and Prevention (cdc.gov), COVID-19 is a new disease, caused by a novel (or new) coronavirus that has not previously been seen in humans. The virus that causes COVID-19 is thought to spread mainly from person to person, mainly through respiratory droplets produced when an infected person coughs or sneezes. Spread is more likely when people are in close contact with one another (within about 6 feet). Symptoms ranging from mild to severe illness may appear 2-14 days after exposure to the virus and may include: cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, new loss of taste or smell. According to the CDC, 35% of COVID-19 patients are asymptomatic, meaning they don’t show any signs or symptoms. Those at high-risk for severe illness from COVID-19 are: people age 65 years and older, people who live in a nursing home or long-term care facility, and people of all ages with underlying medical conditions like chronic lung disease, moderate or severe asthma, serious heart conditions, immunocompromised, severe obesity, diabetes, chronic kidney disease, and liver disease. Please be mindful of these symptoms and of your family’s current state of health. If you believe you or your child are not healthy or at high risk of exposure, we understand your lack of participation at this time. By signing this document, I understand that basketball is a contact sport and that participation of my athlete in The Next Tier, Inc. state or national participation in programs or events (e.g. training, practices, leagues and tournaments) could be hazardous to my athlete and others exposed, both known and unknown to myself, with whom my athlete may have contact with, in or outside of the program for up to fourteen days after exposure to an individual with COVID-19. I understand that if I am in contact with anyone with COVID-19 or other severe contagious illness, I will notify The Next Tier, Inc. immediately to avoid the spread of the virus or disease. Acknowledge the contagious nature of COVID-19 among other infectious pathogens and I voluntarily assume the risk that I and/ or my athlete, may be exposed to or infected by COVID-19 by attending The Next Tier, Inc. programs and that exposure or infection may result in personal injury, illness, permanent disability or death. Understanding that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including , but not limited to, The Next Tier, Inc. coaches, employees, volunteers, athletes, parents, and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any sickness or injury to myself, my athletes and family (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the gym or participation in The Next Tier, Inc. Program (“Claims”).
I hereby release, covenant not to sue, discharge, and hold harmless The Next Tier, Inc., its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the The Next Tier, Inc. its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any program at The Next Tier, Inc.. in the state or a national level. [This waiver is contingent upon a formal agreement between The Next Tier, Inc. and TNT Members or Tryout Participants] In consideration of being permitted to use the gym where The Next Tier, Inc. holds practice or events (Desert Christian High School, Faith Lutheran, Lehman Academy of Tucson, YMCA, Sporting Chance, or any other practice and tournament location in Tucson, AZ or out of state) other owner of the Gymnasium facility and equipment, on behalf of myself, my student athlete, my family, my heirs, and my assigns, I hereby release The Next Tier, Inc. its owners, operators, employees, and agents from liability for injury, death, or property loss suffered by me resulting from the ordinary negligence of Gym Owner and The Next Tier, Inc.its owners, operators, employees, or agents while I and my student athlete am using the facility, equipment, or in any way associated with participating in any and all club activities now or in the future. I acknowledge that I know, understand and appreciate the inherent risks of using each designated Gymnasium/ Gym Owner facility and participation in TNT tryouts, practice, games, activity, program or instructions, including, without limitation, use of the restrooms, parking area, sidewalk, or any of the facilities and equipment at Desert Christian High School or other Gym Facility or The Next Tier, Inc.. I know that these risks range from minor scrapes, strains, and bruises to significant injuries such as broken bones, eye injury or loss, concussion, paralysis, and even death. By execution of this agreement, I fully assume the inherent risks associated with The Next Tier, Inc. athletic club use and assert that I am voluntarily participating in such activities. I hereby give permission to the respective Gym Owner and The Next Tier, Inc. to use me and my student athlete’s image and photographic likeness in all forms and media for advertising, trade and any other lawful purposes. This includes any and all images, photographs, and videos taken of me and my student athlete, without further compensation to me or my student athlete. All film or digital files shall constitute the sole property of the Gym owner and The Next Tier, Inc.
I certify that before each practice, program or event held with or on behalf of The Next Tier, Inc., myself or my athlete will NOT participate if found to have a current fever or any flu like symptoms that make it unsafe for participation. I will notify coaches and not send my athlete if he or she develops a fever, signs or symptoms of any illness or test positive for COVID-19. I agree to the participation guidelines as follows: 1. Washing hands before and after practice 2. Using hand sanitizer frequently 3. Maintaining social distance when coughing or sneezing 4. Check in and check out of my athlete 5. Parent not permitted in the gym during practice

Athlete + Parent Expectations
We believe families should expect an environment that encourages growth and development to achieve success in athletic strength, academics and community leadership. The Next Tier, Inc. (TNT) is a competitive basketball program with a focus on developing committed athletes interested in mastering the game while developing these other strong foundational skills. We recognize and appreciate the amount of time and resources that families have committed to our program and value each individual athlete. Therefore, it is our desire for our athletes along with their families to find TNT as a family oriented community to grow and journey together. We expect this positive disposition to remain in each athlete and family in order to cultivate a healthy atmosphere for growth. Your support allows all coaches and volunteers to exercise their commitment to train and equip each athlete for success at the grade school, high school and collegiate level. Athletes are expected to make their commitment to TNT a priority. We encourage athletes to participate in a variety of activities and sports with the understanding that TNT is their priority activity. Athletes will ultimately make their own personal choices regarding sports however, listed below the expectations upon being a member. Please read through our TNT Expectations of Athletes + Code of Conduct:
- Maintain current registration and payment in our League Apps system
- Attend all practices and show up ready to work
- Be present and give your coach, team and yourself your full attention equally in practice or tournaments Arrive no less than 10 minutes early to practices and games
- Enhance your fundamentals – dribbling, passing, shooting, footwork, defending and rebounding Attend tournaments and games
- Be respectful, attentive, accountable to coaches, teammates, and volunteers during practices and games Communicate directly and respectfully with your coach and teammates. Do not be afraid to speak with anyone privately to ask questions, share concerns or work through disagreements constructively. Respond with a positive attitude on and off the court. This is to be done with words and body language Display good sportsmanship with your teammates on the court, bench and at practice
- Be respectful to volunteers, coaches, officials, opponents, and all fans. No talking back to officials, no exceptions
- Zero tolerance for abusive language, vulgarity, negative remarks to coaches, game officials, opposing team parents, athletes or fans
- Learn from mistakes and remain positive when receiving instruction and feedback from your coach, officials or teammates
- Maintain good work and academic ethics along with good standing in your community and school Participate in community service activities
- Understand the value of managing basketball and academic studies.
- Study hard and focus at school – if your grades or effort in school is not meeting your parents or teacher expectations, this could affect your playing time at a game. School is to remain every athlete’s priority
- Stay out of trouble – make good choices at school, home and the community. Any misconduct of fighting, being disrespectful of people or property and anything your parents deem punishable will result in your playing time at a game
- Be mindful that you represent your family, TNT and community
TRAVEL + PLAYING TIME
All athletes are expected to adhere to TNT’s policies and code of conduct during tournaments and games. There is ZERO tolerance for athletes or parents’ inappropriate behavior. Playing time is dictated by each athlete’s effort, attitude and attendance – No Questions Asked. Athletes are not rewarded if they do not have the best interest of the team in mind at all times. Coaches do their best to even out the playing time, but playing time can fluctuate game-to-game based on the athlete’s efforts to include other factors. Please understand, TNT is a competitive program; we look for serious athletes who want to work and elevate each athlete’s skillset and game. We are not interested in having as many athletes or teams as possible; we are interested in making our athletes better on and off the court. Roster spots are earned each year, and are not automatically given to athletes repeatedly. Commitment to TNT and all basketball related activities should be treated as a priority with academics at the forefront. With that said, athletes are expected to take all academics seriously. To meet the demands of school and outside activities, athletes are expected to budget their time appropriately. Attendance at team activities is expected. A lack of participation impacts on athlete development and the team as a whole. Communication between athletes, parents and coaches are essential for a successful competitive atmosphere to take place. Athletes must prioritize time and activities effectively in regard to maintaining your commitment to TNT. Please discuss these matter with your coach if any issues arise. Again, as collegiate development is a focus our member commitment is year-round. While activity varies by month, athletes should view team activities as a full year process. Development at highly competitive levels does not permit long lay-offs. This is especially true at the older high school ages. Training during the winter and summer months are important. We expect families to honor their commitment to TNT when offered a spot on one of our teams in efforts to remain honest and loyal to the team.
REGISTRATION + FEES
Please read through our TNT Athlete Information Package. If you are planning to be on vacation for more than two weeks, your monthly membership can be removed for that month. Please understand, if you are not present for that month, you may not participate in any games or tournaments. If your athlete sustains a season ending injury, this policy requires that a doctor verify the injury and a written document from the doctor must be presented. At that time, the prorated portion of the member fees for the remainder of the season will be refunded.
VIOLATION OF GUIDELINES
All TNT athletes will be held accountable to the above guidelines & expectations. Any suspected violation may and should be reported to TNT Coaches or Administration Individuals in violation of any of the above expectations and guidelines may be asked to leave practice, tournament or team function. If problems continue to persist throughout the year, additional action may be taken to remove the player from the TNT program. We are proud that this has not been an issue before and the goal of this document is to keep it that way. By signing this document, I agree to follow the above guidelines as an athlete and parent in The Next Tier, Inc., Program (TNT); as governed by a board of directors . I understand that TNT reserves the right to excuse any athlete or parent from a game, tournament or the program if an athlete violates any policies or guidelines
